Agreement to Terms

Services Offered

Black Rhino Construction LLC provides retaining wall installation, excavation, site preparation, drainage solutions, and hardscaping services for residential and commercial properties in Littleton, Colorado and the surrounding Denver metro area.
All services are subject to availability, site conditions, and project feasibility as determined by Black Rhino Construction LLC.

Estimates and Pricing

Estimates provided by Black Rhino Construction LLC are based on information available at the time of inspection and are subject to change if site conditions differ from initial assessment.
All estimates are valid for 30 days from the date of issue unless otherwise specified. Pricing may be adjusted if material costs, labor rates, or project scope changes significantly.
Estimates are not binding contracts until a formal agreement is signed by both parties.

Payment Terms

Payment terms will be outlined in individual project contracts. Black Rhino Construction LLC typically requires:

• Deposit upon contract signing to secure materials and scheduling
• Progress payments tied to project milestones
• Final payment upon project completion and client approval

Payment methods accepted include check, cash, and electronic transfer. Late payments may be subject to interest charges as permitted by Colorado law.

Project Scope and Changes

The scope of work will be defined in the project contract. Any changes to the agreed-upon scope must be requested in writing and approved by Black Rhino Construction LLC.
Changes to project scope may result in adjustments to timeline and pricing. Black Rhino Construction LLC will provide written notice of any cost increases before proceeding with additional work.

Warranties and Guarantees

Black Rhino Construction LLC warrants that all work will be performed in a professional manner using appropriate materials and construction methods. Specific warranty terms will be outlined in individual project contracts.

Warranties do not cover damage resulting from:

• Acts of nature, extreme weather events, or force majeure
• Improper maintenance or modifications by the property owner
• Soil movement or settling beyond our control
• Normal wear and tear over time

Manufacturer warranties on materials (pavers, decking, etc.) are passed through to the client and governed by the manufacturer’s terms.

Limitation of Liability

To the maximum extent permitted by Colorado law, Black Rhino Construction LLC’s liability is limited to the total amount paid for the specific project in question.

Black Rhino Construction LLC is not liable for:

• Indirect, incidental, or consequential damages
• Delays caused by weather, material availability, or circumstances beyond our control
• Pre-existing site conditions not disclosed during initial inspection
• Damage to underground utilities not properly marked by utility companies

Insurance and Licensing

Black Rhino Construction LLC maintains general liability insurance through Next Insurance. Projects requiring specialized engineering or exceeding standard coverage may need additional insurance documentation at the client’s expense.

Property Access and Site Conditions

Clients must provide Black Rhino Construction LLC with clear access to the work site during scheduled project hours (Monday–Saturday, 7:30 AM – 6:00 PM).

Clients are responsible for:

• Marking underground utilities before excavation begins
• Securing pets during work hours
• Removing obstacles that may interfere with construction
• Notifying HOA or obtaining necessary permits if required

Black Rhino Construction LLC reserves the right to suspend work if site conditions become unsafe or if access is restricted.

Intellectual Property

All content on the Black Rhino Construction LLC website, including text, graphics, logos, and images, is the property of Black Rhino Construction LLC or its content suppliers and is protected by United States and international copyright laws.
Project designs, plans, and estimates created by Black Rhino Construction LLC remain our intellectual property unless otherwise agreed in writing.

User Conduct

When using our website or contacting us, you agree to:
